Terms of Service

1. Agreement to Terms

By accessing or using the ATK Digital Infrastructure website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.

2. Services

ATK Digital Infrastructure provides website design, development, digital marketing, and related software services to businesses ("Clients"). Specific deliverables, timelines, and pricing are governed by individual service agreements or proposals agreed upon in writing between ATK and the Client.

3. Client Responsibilities

• Provide accurate information necessary for project completion.
• Respond to requests for feedback or approvals in a timely manner.
• Ensure you have rights to any content, images, or materials you provide to ATK.
• Pay invoices according to the agreed payment schedule.

4. Intellectual Property

Upon receipt of full payment, ATK assigns to the Client all rights to custom deliverables created specifically for that Client. ATK retains rights to proprietary frameworks, tools, templates, and methodologies used in the creation of deliverables. ATK may display completed work in its portfolio unless otherwise agreed in writing.

5. Payments & Refunds

Payment terms are specified in each service agreement. All fees are non-refundable once work has commenced unless ATK fails to deliver agreed services. Late payments may incur a fee of 1.5% per month on the outstanding balance.

6. Limitation of Liability

To the maximum extent permitted by law, ATK Digital Infrastructure shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability to any Client for any claim shall not exceed the total fees paid by that Client in the three months preceding the claim.

7. Confidentiality

Each party agrees to keep confidential any non-public information shared by the other party in the course of the business relationship. This obligation survives termination of the service agreement.

8. Termination

Either party may terminate a service agreement with 14 days written notice. ATK reserves the right to suspend or terminate services immediately for non-payment or material breach of these Terms.

9. Disclaimers

ATK does not guarantee specific business outcomes, revenue, or search engine rankings. Results depend on many factors outside our control. Services are provided "as is" to the extent permitted by law.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.

11. Changes to Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of our Services after changes constitutes acceptance.
